摘　　要：建设工程合同无效后涉及承包人为建设施工项目付出费用的折价补偿问题,尚未施工的建设项目如何进行折价补偿在实践中争议较大,本文结合实践经验和法律规定,分析了施工合同无效且未施工的情形下承包人损失包含的内容以及如何确定。After the construction project contract is invalid,the problem of the contractors discount compensation for the cost of the construction project is involved.How to make the discount compensation for the construction project that has not yet been constructed is controversial in practice.This paper analyses the contents of the contractors loss and how to determine them in the case of the invalidity of the construction contract and the absence of the construction according to the practical experience and legal provisions.
