摘　　要：刑事附带民事调解是一种旨在化解矛盾纠纷,促进社会和谐的制度设计。该制度的优势得以充分发挥有赖于调解主持者即法官对有规律性的三种关系进行深入地发掘、剖析、归纳和再认识。刑事被告人、被害人及其各自家庭之间对立而紧张的关系是刑事附带民事调解制度运行的前提,改变并缓解此种紧张关系是该制度的宗旨之一。由于此种对立状态的激烈性,矛盾双方急需选择合适的人选充当"话事人"的角色,这就在当事人与调解代表之间形成了一种不完全等同于"主雇"的特殊关系,这一关系对调解的成败起着至关重要的作用。刑事附带民事调解毕竟是与国家刑罚权的适用相生相伴的,国家希望通过该制度达到维护、巩固其统治秩序和实现社会管理职能的目的,在这一目的之下,当事人双方才有了觅得实现自身利益的良机。国家意志与公民私权之间的共赢关系体现了刑事附带民事调解制度的本质特征。Criminal incidental civil mediation is a kind of system design aimed at resolving contradictions and disputes and promoting social harmony.The advantages of this system can be fully realized by the moderator of the mediation,namely the judge,who deeply explores,analyzes,induces and reunderstands the three relationships with regularity.The antagonistic and tense relationship between criminal defendants,victims and their families is the precondition for the operation of the criminal incidental civil mediation system.Due to the intense opposition,both parties urgently need the right person to act as the“speaker”,which forms a special relationship between the parties concerned and the mediation representatives that is not exactly equivalent to“master employment”,which plays a vital role in the success or failure of the mediation.After all,criminal incidental civil mediation is accompanied by the application of the state's right to punishment.The state hopes to maintain,consolidate its ruling order and realize social management functions through this system.The win-win relationship between the national will and the private right of citizens reflects the essential characteristics of the criminal incidental civil mediation system.
