摘 要:体育赛事转播权并非严谨的法律概念,它包含了体育赛事节目、体育赛事转播信号和体育赛事本身三个层次,脱离体育赛事这一层次讨论其法律保护是不现实的。同时,体育赛事转播权涉及到权属、分配、垄断和公益四大问题,其背后存在赛事组织者、参赛者、传播者和社会公众等多个群体的利益博弈;望文生义地在知识产权框架内寻求体育赛事转播权的法律保护,无论在理论上还是实践中都是行不通的。只有充分考虑各利益群体的诉求,具体解决四大问题,系统性地界定权利并制定配套规定,方为体育赛事转播权的法律保护路径。Strictly speaking,Sports Broadcasting Right is not a legal concept.It consists of three levels:sports program、sports transmission signals and sports event itself.Therefore,to protect Sports Broadcasting Right without considering sports event is unrealistic.In the meantime,Sports Broadcasting Right involves four major issues:ownership,distribution,monopoly and public welfare.Several interest groups such as event organizers,sport participant,communicator and the public are playing interest game for it.To protect Sports Broadcasting Right literally in the framework of Intellectual property law will not work in theory or practice.Only by fully considering the appeals of different interest groups,solving the four major issues,defining rights systematically and formulating supporting regulations,can Sports Broadcasting Right be protected.
