旅游网络交易平台法律规制问题研究

摘　　要：文章以一起发生交通事故的出境游为切入点,细致分析了销售该出境游产品的旅游网络交易平台的行政和民事法律责任。由此发现,就平台上违法经营旅游业务的问题,现有的针对平台的法律规制措施存在明显不足,既不能有效制止违法经营行为,也很难有效救济被侵害旅游者的权益。其原因主要是规制措施本身不具有合理性:一是对于平台上严重性完全不同的违法经营和一般民事侵权,平台的法律责任负担并无实质性差异;二是规制所隐含的两个前提假设,即平台与经营者是平等主体、平台是独立于交易双方的中立主体,在实践中是不成立的。改变民事规制是解决这一问题较为可行的方案,该方案既符合公平对等的原则,也是帕累托更优之选项。这一方案直接保护了旅游者的权益,同时也会倒逼平台加强对违法经营情况整治,从而弥补行政监管上的无力和不足。The article fully analyzed the administrative legal liability and the civil legal liability for the tourism online trading platforms when they selloutbound tourism products by reviewing a traffic accident in an outbound trip. When facing illegal operations on the platform, it can be easily seen that current legal regulations can neither restrain illegal operations nor help protect the rights and interests of tourists effectively. Current legal regulations have evident defects. It is primarily because some regulations themselves are irrational. First, the platform carries liabilities with no substantial differences for both serious illegal operations and regular civil tort. Second, the two assumptions implied in regulations that the platform and operators are equal parties and the platform is an independent and neutral party from both sides of the trade are invalid in practice. A practical proposal of changing civil regulations therefore is put forward. It is in conformity with the principle of fairness and equality. And it is also Pareto Superior, the better option. The proposal protects the rights and interests of tourists directly. Meanwhile, it forces the platform to enhance supervision on illegal operations, making up for the lack of administrative supervision.
