行政处罚简易程序的立法本义及其司法适用——从某高速公路超速行政处罚程序适用争议案谈起  

On the Original Meaning of Administrative Penalty Summary Procedure and Its Judicial Application: A Talk on the Basis of the Cases under Dispute in Administrative Penalty Procedure Application for Speeding on a Highway

摘　　要：《行政处罚法》规定的行政处罚简易程序是指当场作出处罚决定的程序,《道路交通安全法》和最高人民法院的司法解释均没有改变《行政处罚法》这一立法本义。而公安部《道路交通安全违法行为处理程序规定》却将简易程序视为"可以当场作出处罚决定,也可以事后作出处罚决定"的规定事实上背离了上位法的立法本义,法院在司法裁判中应当对其进行审查并舍弃,依据上位法裁判以维护司法公正。Administrative penalty summary procedure specified in "Law on Administrative Penalty" refers to the procedure for making a penalty decision on the spot. Neither of " Road Traffic Safety Law" and judicial interpretation given by Supreme People’s Court changes the original meaning of "Law on Administrative Penalty". "Provisions on the Handling Procedures of Road Traffic Safety Violations" issued by Ministry of Public Security views summary procedure as regulation of either on-the-spot penalty decision or later-on penalty decision, which virtually divorces from the original meaning of the higher rank law. The court should review and then discard it in judicial adjudication process, firmly maintaining judicial justice on the basis of the judgement of the higher rank law.
