图形用户界面设计的合理观察视角探析

摘　　要：为使图形用户界面设计得到妥善的法律保护。在对图形用户界面设计进行观察时,基于不同的情形,将产品与设计进行完全分离或不完全分离。搭建一个多元动态的法律保护体系。对于那些既具备功能性又具有观赏性的设计,应尽可能地将产品与设计相分离,并采著作权法或反不正当竞争法予以保护。而对于那些观赏性不强而以实用性为主的图形用户界面设计,将设计与产品予以适当分离,并采局部外观设计保护制度予以保护。In order to properly protect GUI design by law,This paper observing the GUI design based on different situations,product and design are completely or incompletely separated,and different legal norms are adopted according to different situations.Setting up a pluralistic and dynamic legal protection system.For those designs which are both functional and ornamental,we should separate products from designs as far as possible,and adopt copyright law or anti-unfair competition law to protect them.For those GUI designs which are not ornamental but mainly practical,the design and products should be separated appropriately,and the protection system of partial appearance design should be adopted to protect them.
