摘 要:错案责任追究制度存在着因地区性差异和对"错案"概念理解上的差异带来的混乱,存在因内部司法文件制定主体地位带来的法律效力问题。完善错案责任追究制有三条路径可供选择,但最佳路径是以提高制度的法律位阶、坚守效力的全国统一性、增强该制度的合理性为原则,重新检视现有的错案责任追究制的每个技术环节的具体规范内容,将其作充分合理化修订后统合纳入《法官法》和《检察官法》。There exists confusion in the system of accountability for misjudged case due to the regional differences and the differences in understanding the concept of“misjudged case”and the issue of the force of law due to the status of the decision-making body of internal judicial documents.There are three ways to improve the system of accountability for misjudged case.However,the best way is to take improving the legal hierarchy of the system,adhering to the national unity of the force,and enhancing the rationality of this system as the principle,to re-examine the specific normative content of each technical link of current system of accountability for misjudged case,and to integrate it into the Judges Law and the Public Procurators Law after its adequate rationalized revision.
