摘　　要：根据禁止重复授权原则,同日提交的彼此近似的外观设计申请只能获得一项专利权,在审查实践中,就会存在同一申请人的多项近似设计无法获得全面、有效保护的问题。本文针对上述问题结合多例实际判例,从专利法规、司法判决、申请人保护初衷、审查制度等多个角度进行了分析与探讨,并给出了合理化的审查建议和对中国外观制度改进的建议。According to the rule of prohibition of double patenting, the similar industrial design applications submitted on the same date can only obtain one patent right. In the examination practice, there will be the problem that many approximate designs of the same applicant cannot be fully and effectively protected. This paper analyzes and discusses the above problems in combination with many practical cases, and rom different angles, such as patent regulations, judicial decisions, the original intention of applicant protection, the patent examination system, and so on. At the same time, the paper gives the rational examination suggestion and the suggestion to the improvement of the patent system of China’s industrial design.
