机构改革大背景下对航运公司安全与防污染监管职责的思考和建议

摘　　要：目前,航运公司安全与防污染监管工作存在职责交叉、多重执法和权责不一致等情况,在当前国务院机构改革的大背景下,涉及水上安全管理的部门职责面临重新整合优化,文中通过分析航运公司安全与防污染各相关部门监管职责和执法依据,提出明晰职责、权责对等的监管职能调整思路,避免多头执法模式,力图从根本上解决困扰航运公司监管工作多年的各项问题,以提高政府监管效能及航运公司安全与防污染管理水平。Such problems as overlapping responsibilities, multiple law enforcement and authority-responsibility inconsistency exist in the present safety control and pollution prevention of shipping companies. Under the background of institutional reform and function transformation of the State Council, the responsibilities of waterborne safety administration departments will be integrated and optimized. Based on the analysis of the responsibilities and legal basis for law enforcement of relevant departments concerning the safety control and pollution prevention of shipping companies, the paper proposes the train of thoughts for clarifying functions and realizing equity between authorities and responsibilities, aiming at avoiding multiple law enforcement mode, substantially solving the problems with shipping company management in the past years, and enhancing the efficiency of government administration as well as the level of safety control and pollution prevention of shipping companies.
