摘 要:参考西方公平研究实验范式,以"独裁者实验""最后通牒实验"和"第三方裁判实验"为模型进行实验设计,研究青年的公平感和决策。实验结果表明,青年大概率地具有倾向于公平的思维、决策或行为;性别对公平感和决策有一定影响但不显著,法学教育的影响较大;被试者的分配公平、评价公平和惩罚公平具有相关性;制度规则对行为公平的影响显著。公平是人类合作的重要基础,公平感和公平行为仍存在差距,需要一定的制度保障,需要通过法律制度建设保障公平,强化程序公平,同时加强对青年的法制教育。Referring to the experimental paradigm of western fairness study,we conduct the experimental design with the models of "dictator experiment""ultimatum experiment " and "third-party referee experiment"to study the youth’s sense of fairness and decision-making. According to the experimental results,the youth have the thinking,decision-making or behavior towards fairness with great probability;the gender has some influences on the sense of fairness and decision-making but not significant,while the influences of legal education are relatively large; there are correlation among the subjects’ distribution fairness,evaluation fairness and punishment fairness; the institution rule has significant influence on behavioral fairness. The fairness is important basis for human cooperation. There still exists the gap between sense of fairness and fair behavior,this requires certain institutional guarantee. Therefore,we should ensure the fairness through legal system construction,strengthen procedural fairness; meanwhile we should also strengthen the legal education towards youth.
