长期照护保险财政补贴的社会法约束——以社会基本权为约束工具

摘　　要：国家具有构建长期照护保险并给予充足的财政支援之义务,以化解老年风险。长期照护保险财政补贴,须接受社会基本权的约束。社会基本权的结构模型包括生存权、财产权以及平等权,长期照护保险财政补贴制度的构建,应当充分贯彻上述权利理念。具体而言,在生存权保障面向上,应对长期照护保险财政补贴目的予以整体化考量;在财产权保障面向上,应确立长期照护保险财政补贴支出的规范化保障;在平等权保障面向上,应逐步将适龄的全体国民纳入长期照护保险财政补贴的对象范畴。For resolving old-age risk,our nation has the duty to set up long-term care insurance care with enough financial subsidies.It is necessary to bear the constraints of the social fundamental rights for the financial subsidies of long-term care insurance.The social fundamental rights contain the right of survival,the right of property and the right of equality.And it’s essential to implement concepts of the above rights as building the financial subsidies systems of long-term care insurance.Firstly,the financial subsidies of the insurance of long-term care should be considered as a whole in order to guarantee the right of survival.Secondly,it’s vital to provide reasonably the financial subsidies of long-term care insurance to assure the right of property.Thirdly,all citizens should be brought into the object category of the financial subsidies of long-term insurance for guaranteeing the right of equality.
