论创新文化驱动下大学生创业的法律风险及防范

摘　　要：大学生自主创业符合我国当前大众创业、万众创新的发展要求和趋势,能够有效缓解大学生就业难问题。但由于不能正确应对和化解创业过程中遇到的各类法律风险,大学生自主创业的成功率依然比较低。对大学生创业初期、创业实体运营及创业实体终止后等各阶段面临的法律风险进行系统分析,从国家、社会、高校及创业者本人四个方面完善相关的法律和政策,完善高校对大学生的创业教育体系,提升创业大学生自身能力和风险防范意识,可以有效提升大学生创业成功率。The university students’self-employment is in accordance with the social development tendency of mass’work-pioneering and innovation.It can effectively relieve the university students’difficulty in employment.However,due to the incorrect defusing of the various legal risks met in the work-pioneering,they seldom succeed in their self-employment.This paper has systematically analyzed the risks in the beginning,running and end of their pioneered enterprises.And it has proposed that the relevant laws and policies should be perfected from aspects of our nation,society,universities and students in attempt to improve their ability and risk-prevention consciousness and increase their success rate in work pioneering.
