摘 要:1978年以来的改革开放和市场经济的快速发展导致了中国社会基本结构的根本变化。现代工商社会和城市中国内生了对"规则之治"和程序法治的制度需求。正是在这一现代化进程中,中国司法改革的出现、发展和变迁背后的潜在逻辑才得以凸显。法官管理制度的改革是中国司法改革的重要部分,通过展示相关改革举措之间的制度张力以及与基于信息经济学和激励理论的理论推演之间的比较,可以揭示出深层制度之间的矛盾和冲突。虽然最新一轮改革的实效还有待检验,但中国法院的法官管理变革确实需要一种整体的制度考量和一种基于社会科学的理论指导。China's reform and opening-up and the development of market economy have led to a fundamental change in its basic social structure since 1978.Modern business society and urbanized China have generated an institutional demand for rule of law and modern procedural law.It is in this modernization process that the logic underlying the development of Chinese judicial reform has been revealed.The reform of judge management system is an important part of Chinese judicial reform.Through revealing the institutional tension among the policies and measures concerning the reform and comparing the theoretical consequences of information economics and incentive theory,this paper tries to show the conflicts and tensions between the relevant systems.Though the effect of the latest round of judicial reform remains to be tested,the reform of judge management system in China needs a holistic analysis of the system and a theoretical guidance from social sciences to a great extent.
