基于越轨生涯理论的当前我国社区矫正组织化路径反思与再构

摘　　要：当前我国社区矫正工作是在社区矫正机构领导下的社区矫正小组组织实施的,它是社区矫正制度付诸实践过程中诸多因素综合作用的产物,具有理论和现实的双重意义。然而,其个别化的刑罚执行方式导致了社区服刑人员的"对象化"。基于越轨生涯理论的启示,社区服刑人员真正实现向社会的顺利回归,不仅需要外在的环境和资源,更需要社区服刑人员能够对自身角色的认同与接收。要实现这一目的,要在坚持既有的个别化刑罚执行方式的基础上实现社区服刑人员的组织化,这两重维度的组织化的耦合关键在于社会工作者的角色调整。At present,community correction work in China is organized and implemented by community correction teams under the leadership of community corrections institutions.It is the product of the comprehensive effect of many factors in the process of putting the community correction system into practice,and it has the dual meaning of theory and reality.However,its individualized execution of penalties has led to the"objectification"of community prisoners.Based on the Inspiration of the theory of deviant career,the community prisoners not only need external environment and resources,but also need the community prisoners recognize and receive their own roles in order to truly realize the smooth return to society.To achieve this goal,the organization of community prisoners will be realized on the basis of adhering to the existing individualized punishment execution methods.The key to the integration of these two dimensions is the role adjustment of social workers.
