英式橄榄球裁判自由裁量权原则理论研究

摘　　要：采用判例法和诠释法,对英式橄榄球裁判自由裁量权原则理论进行研究,旨在为我国英式橄榄球的发展提供理论依据。结果显示:我国英式橄榄球正处在发展的初级阶段,裁判员的理论体系尚不完善,裁判在自由裁量时迫需要原则的导向,在自由裁量时,需要遵循安全第一、君子之争、利益层次和比赛流畅性四条主要原则的指引。Aimed at provide some theoretical references for our rugby development, this article studies the principle of Rugby referee’s discretion, by using the methods of case-law and hermeneutics;and it gets the results that the development of rugby in China is in the initial stage and the theoretical system of the referees’ cultivating is incomplete;the referees are in urgent need of the principle guiding while they exert discretion with following 4 leading principles of safety first, healthy competition, interest levels and smooth competition.
