电子商务领域专利侵权法律规制——行政保护引领下的ODR协同治理机制

摘　　要：专利行政执法在我国电子商务领域专利纠纷多元化解决中发挥着重要作用,探索构建专利行政保护引领下的在线争端解决协同治理机制,方能更好地顺应电子商务发展之需求。专利行政执法协同保护机制须明晰专利行政部门、知识产权维权援助中心、电商平台各自定位与职责,鼓励电商平台建立健全内部维权机制、强化知识产权维权援助中心协同保护作用、加强专利行政部门执法能力建设。专利行政调解服务水平和能力的提升,尚需着力做好调解服务主体多样化、调解服务手段多元化、调解服务程序精细化、调解协议效力明确化建设。行政保护与在线争端解决的协同治理能够充分发挥在线投诉处理、在线调解、在线仲裁的线上纠纷解决"供给侧"效应,如何实现上述解纷路径的联通与融合是当下之要务。Patent administrative enforcement plays an important role in diversified settlements of patent disputes in the field of e-commerce in China.To explore the cooperative governance mechanism of online dispute resolution under the guidance of constructing patent administrative protection is the key to meet the demand the development of e-commerce.The cooperative protection mechanism of patent administrative law enforcement should clarify the patent administration department,the intellectual property rights protection assistance center and the positioning and responsibilities of e-commerce platform,encourage e-commerce platforms to build internal rights protection system,strengthen the cooperative protection role of intellectual property rights assistance center and strengthen the construction of law enforcement capacity of patent administrative departments.In order to improve the patent administration and the capacity of mediation services,we should focus on the diversification of mediation service subjects,the diversification of mediation service means,the refinement of mediation service procedures,and the construction of mediation agreement effectiveness.The collaborative governance of administrative protection and online dispute resolution could give full play to the“supply side”effect of online dispute handling.How to realize the interconnection and integration of the above-mentioned path is the priority of the moment.
