摘　　要：学习西方发达国家的油气法治体系,借鉴其管理油气行业的成功经验对解决我国油气产业发展难题十分必要。加拿大石油的商业开采形成较为完整的、独具特色的油气法治体系。其法律规范一般分为联邦和省(区)两级,对原住民土地上涉及油气开发的还单列法律。油气资源开发的法律程序主要地表土地进入权、探采矿权的获取和监督管理。借鉴加拿大油气立法理念、完善的油气法治体系及高效可行的油气资源管理制度有重要的理论和现实意义。It is very necessary to learn the petroleum legal system in western developed countries and to draw experiences from the successful practices of their management in oil and gas industry. Canada has formed a relatively complete, unique legal system in the field of oil and gas development. Its legal norms are generally divided into federal and provincial (district) levels, in addition to the separate law on oil and gas development in the indigenous land. The legal procedures for the developing oil and gas resources mainly include the right of land access, the right of exploration and mining, and the supervision and management. It has important theoretical and practical significance for our country to learn and draw from the advanced ideas of petroleum legislation, the perfect legal system and the efficient, practical petroleum management system in Canada.
