摘　　要：基于合同状态理论,揭示了合同价款争议的形成机理。通过案例分析与文献研究对诱致建设工程合同价款争议的影响因素进行了归纳整理,识别出18个影响因素,从合同当事人、合同本身、工程本身和环境层面进行划分。采用解释结构模型方法对合同价款争议影响因素之间的关系进行了研究分析,构建了四级层次结构模型。研究结果表明:不遵守法律法规、缺乏诚信意识和管理水平低是建设工程合同价款争议产生的根本因素。根据研究结果,提出了预防对策,可为发承包双方防范合同价款纠纷提供参考。Based on contract state theory,this paper reveals the formation mechanism of contract price dispute.Through case analysis and literature study,this paper sums up and arranges the influencing factors of contract price disputes.It identifies 18 influencing factors,which are divided into four aspects:contract parties,contract,project and environment.The relationship between the factors influencing the contract price dispute is studied and analyzed by using the method of interpretive structure model,and the four-level hierarchy model is constructed.The results show that the fundamental factors of the disputes are not obeying the laws and regulations,lacking the sense of good faith and low management level.According to the research results,the preventive countermeasures are put forward,which can be used as a reference for contractors to prevent contract price disputes.
