国际体育仲裁院仲裁规则的更新与重塑——以反兴奋剂部门为视角

摘　　要：现代体育的蓬勃发展似乎与兴奋剂的蔓延呈正相关关系,2016年全球体育界的两件大事即为里约奥运会的举行和俄罗斯兴奋剂事件的持续发酵。虽然目前对于俄罗斯兴奋剂事件尚无定论,但加强对兴奋剂违规行为的打击力度早已是共识,其中,对兴奋剂纠纷解决机制的改良实为重要一环。国际体育仲裁院体系下反兴奋剂部门的设立,在一定程度上突破了传统兴奋剂管控体系的固化模式。针对ADD兴奋剂纠纷一审仲裁机构的定位,《ADD仲裁规则》在制度设计上予以了细化,同时强化了对实体正义和程序正义的双元追求,扩充了程序扶助制度以保障弱势当事人之正当权益。虽然《ADD仲裁规则》依然对严格责任规则采固守之态,但我国可辅以比例原则予以妥适适用。在制度构建上,我国应突破兴奋剂仲裁程序的固有路径,从多维度保障运动员的正当权益,以实现程序正义和实体正义。The vigorous development of modern sports seems to be closely related to the spread of doping.The two major events in the field of global sports in 2016 were the hosting of the Rio Olympics and the fermentation of Russian doping.Although there was no definite conclusion about Russian Doping,it became a consensus to strengthen the crackdown on doping,and the improvement of the doping mechanism.The establishment of ADD under the CAS System,to a certain extent,broke through the curing mode of the traditional doping control system.As the first instance arbitration institution and "Arbitration Rules applicable to the CAS Anti-doping Divisions" in the system design to be refined,ADD strengthens the substantive justice and procedural justice of the dual pursuit of the expansion of the program support system to protect the legitimate rights and interests of vulnerable parties.Although the "Arbitration Rules Applicable to the CAS Anti-doping Divisions" still adheres to the strict liability rules,China can supplement the principle of proportion to be properly applied.In the system construction,China should make breakthrough in the doping arbitration procedure,ensure the multi-dimensional protection of the legitimate rights and interests of the athletes in order to achieve procedural justice and substantive justice.
