摘 要:提升透明度作为国际投资仲裁改革的重要举措,旨在实现国际投资仲裁的公开。公共利益的介入侵蚀了仲裁的保密性,为国际投资仲裁公开制度的引入创造了前提条件。现阶段国际投资仲裁的公开仍存在任意性、不平衡性和公开水平不高等问题。为解决这些问题,应通过多双边投资条约、仲裁规则、统一国际公约三种路径,建立起具有约束力的公开保障机制。在国际投资仲裁改革的背景下,立足于我国对待国际投资仲裁公开的缔约实践和司法实践,我国应当顺势而行,及时回应国际投资仲裁的透明化趋势,从允许公开仲裁裁决开始,逐步接纳国际投资仲裁公开制度。As one of the important reform measures of international investment arbitration, transparency mainly aims to promote publicity of investment arbitration. The involvement of public interest has eroded the confidentiality of arbitration and provided the preconditions for a disclosure regime in investment arbitration. At present, publicity of international investment arbitration still has problems such as arbitrariness, imbalance and low publicity. In order to solve these problems, a binding transparency regime should be established through multi-bilateral investment treaties, arbitration rules and international conventions. In the context of the reform of international investment arbitration and China s experience in treaty negotiations and judicial practice, China should respond to the transparency trend, nod to the disclosure of arbitral awards and gradually accept the transparency regime of investment arbitration.
