摘 要:第三方资助仲裁,作为国际仲裁领域的热点话题,已被广泛地关注。2018年,联合国国际贸易法委员会第三工作组第三十五届会议提出,应对第三方资助仲裁相关问题做出重大关切,此外,在讨论仲裁员的道德准则议题时,特别指出第三方资助公司对仲裁员的独立公正性的负面影响。第三方资助公司与受资助方之间的契约保密性阻碍了仲裁程序的其他参与人对仲裁员与第三方资助公司之间潜在利益冲突的认知。因此,构建第三方资助下的仲裁员潜在利益冲突披露制度显得尤为重要,同时,对《中华人民共和国仲裁法》的修改是否应该将第三方资助问题纳入其中作出回应。Third party funding,as a hot topic in international arbitration community,has been paid widespread attention.In 2018,Report of Working Group III on the work of its thirty-fifth session Part-I stated that third party funding has become a significant concern;meanwhile,when discussing the issues on the arbitrator's ethical standard,the Report especially referred to that the session should pay more attention to negative impact of third party funding on the impartiality and independence of arbitrators.Because of contractual confidentiality between third party funder and the funded party,this confidentiality barriers other participants in the process of arbitration to recognize the potential conflicts of interest between arbitrators and third party funder.Therefore,it is essential to disclose third party funding arrangement and establish the proper disclosure obligation,and respond to the question whether the modification on the Arbitration Law of the People's Republic of China should consider relative issues on third party funding.
