摘　　要：中国改革开放40年来,与经济、政治、文化、社会等诸多领域一样,行政法制建设也走过了艰难曲折和成绩斐然的跨越发展历程。注重学习借鉴别国经验,使得我国的行政法制建设获得了巨大进步,同时在结合中国国情推动创新发展方面也具有诸多亮点,其中主要有民主化、精细化、法治化等重要特点,它们分别是中国行政法制变迁的本质特征、形态特征和功用特征。这次党和国家机构改革对行政法制建设带来新机遇和新挑战,通过观念更新、制度创新去抓住机遇、迎接挑战,有助于促成新行政法的成长发展,以达到深入推进依法行政、加快建设法治政府的深度转型发展目标。In the past 40 years since China’s reform and opening up, as in many fields such as economy, politics, culture and society, the construction of administrative legal system has also gone through a difficult and tortuous course of development with remarkable achievements. Emphasis on learning from the experience of other countries has made great progress in the construction of administrative legal system in China. At the same time, it has many characteristics in promoting innovation and development in the light of China’s national conditions, including democratization, refinement and legalization, which are the essential, morphological and functional characteristics of the change of China’s administrative legal system. The reform of the Party and state institutions has brought new opportunities and challenges to the construction of administrative legal system. To seize the opportunities and meet the challenges through the renewal of ideas and system innovation will contribute to the growth and development of the new administrative law, so as to achieve the development goal of deepening the transformation of administration by law and accelerating the construction of a government ruled by law.
