我国非道路移动机械排污申报制度的几个问题探析

摘　　要：非道路移动机械污染已是重要的污染源。《环境保护法》和《大气污染防治法》修订时删除了排污申报登记制度,《大气污染防治法》中的排污许可制度不适用于非道路移动机械,但加强制度在其防治中的作用很有必要。因此,非道路移动机械排污申报登记就只能由地方立法弥补。相对于普查登记,非道路移动机械排污申报制度更为合理,申报主体为非道路移动机械使用者。非道路移动机械排污申报的性质应是备案而非许可制度;一些地方混淆了备案与许可的界限,应予以纠正。The declaration system was deleted by the revised Environment Protection Law and Air Pollution Prevention&Control Law.The pollutant discharge permit in the latter law can't be app-lied to non-road mobile machinery pollution.Non-road mobile machinery pollution has been alre-ady an important one.Pollution discharge declaration system seems more reasonable than other declarations and better than the census registration in mastering information of non-road mobile machinery pollution.The regulation on use of non-road mobile machinery is just in the record,but not permit.
