职业性肿瘤(苯白血病)停工留薪期确认的典型案例分析

摘　　要：目的 :探讨职业性肿瘤(苯白血病)停工留薪期起始时间的确认。方法 :对1例白血病患者在申请职业病诊断过程中死亡,职业病诊断机构出具证明为"职业性肿瘤(苯白血病)已死亡"的案例进行分析。结果 :工伤认定机构依据职业病诊断证明完成了工伤认定,鉴定机构明确了停工留薪期起始时间,给出了停工留薪期内死亡的鉴定结论,患者家属获得了应有的工伤赔偿。结论 :以劳动者要求职业病诊断、提交有关资料并填写职业病就诊登记表时间为停工留薪期起始时间较为合适。Purpose:Discuss the confi rmation of the starting time of the period of leave without pay due to the occupational tumor(leukemia caused by benzene).Method:Carry out analysis on the case of 1 patient with leukemia who died in the process of applying for occupational disease diagnosis causing the certifi cate issued by the occupational disease diagnosis institution was"patient with occupational tumor(leukemia caused by benzene)died".Result:According to the diagnosis of occupational disease,the Work-related Injury Certifi cation Institution had completed the identification of the work-related injury,and the Authentication Institution had made clear the beginning of the period of leave without pay and provided the authenticate conclusion that died in the period of leave without pay,thus the family members of the patient had received the due compensation for the workrelated injury.Conclusion:It is relatively appropriate to regard the date when workers request to implement the occupational disease diagnosis,submit relevant materials and fill in the occupational disease registration form as the starting time of the period of leave without pay.
