摘 要:我国体育公共服务领域存在着"软硬兼施"的混合法结构。软法具有严格区别于硬法的个性特征与独特功能。通过对体育公共服务软法的实证考察,分析软法创制与运作机制,软法的规范结构与分类。体育公共服务领域软法之治有利于促进体育公共服务领域多元化治理主体发展,实现公民体育权利。当前,体育公共服务软法之治存在理念缺失、规范性不足等问题,应针对当前存在问题做出变革,提升体育公共服务软法的品质,以全面实现体育公共服务的法治化目标。China's sports public service has both hard and soft law structure. Soft law is strictly different from hard law with its unique characteristics. Through the empirical study of the soft law of sports public service, this paper analyzes the mechanism, the normative structure and classification of the soft law. The rule of soft law in the field of sports public service is conducive to promoting the development of diversified governance subjects in the field of sports public service and realizing citizens sports rights. At present, there are problems such as the lack of concept and standardization which needs reform for improving the quality of soft law of sports public service so as to realize the goal of legalization of sports public service in an all-round way.
