摘　　要：导致刑事错案屡禁不止的原因十分复杂,甚至是在多种因素综合作用下的结果。刑讯逼供、违背证据规则和诉讼程序、口供成为定罪的主要依据等是导致刑事错案的重要原因,为有效防止刑事错案的发生,应完善"无罪推定"原则,重视辩护律师的作用,加强公检法相互间的监督与制约,完善申诉制度。The reasons for the repeated incontinence of criminal cases are very complex, even under the combination of various factors. Torture, violation of rules of evidence and litigation procedure, oral confession as the main basis of conviction is the important causes of criminal misjudged cases, to effectively prevent the occurrence of criminal misjudged cases should perfect the rules of“presumption of innocence”, attach importance to the role of defense lawyers, courts mutual supervision and restraint reinforced, refining the illegal evidence exclusion rule, improving the appeal system.
