摘 要:1993年10月1日,《国家公务员暂行条例》开始施行,中国建立了现代公务员制度。2018年末,《中华人民共和国公务员法》修订案颁布。从《国家公务员暂行条例》到《中华人民共和国公务员法》,再到2018年新修订的《公务员法》,在推进国家治理体系和治理能力现代化及全面推进深化改革过程中,中国公务员管理法律体系日渐完善,形成了具有鲜明中国特色的现代公务员制度。公务员制度的中国特色集中体现在《公务员法》中,主要表现为《公务员法》作为中国公务员管理、干部管理的"母法"和总章程,坚持党管干部原则;通过《公务员法》较为全面融合我国现代公务员制与党的干部制度;通过《公务员法》明确保障公务员合法权利。On 1st Oct.1993,the Provisionary Regulations on the Civil Servants were enforced and China established modern civil servant system.At the end of 2018,the Amendment of Civil Servant Law of People’s Republic of China published.From the Provisionary Regulations on the Civil Servants to the Civil Servant Law of People’s Republic of China,to the Amendment of 2018,the legal system for the management of civil servant in China has been gradually improved and a modern civil servant system with distinct Chinese characteristics has been formed in the process of modernizing the country’s governance capacity and system as well as advancing the reform.The Chinese characteristics of the civil servant system are mainly embodied in the Civil Servant Law of People’s Republic of China,which is the parent law and general constitution for the management of civil servants and cadres in China and adheres to the principle of Party-managed cadres likewise can fuse the Modern Civil Servant System and Party Cadre System and guarantee the legal rights of civil servant.
