摘　　要："套路贷"犯罪不是一种具体的犯罪行为,而是一系列的犯罪行为的总称。"套路贷"与民间高利贷之间存在目的、手段及法律后果的不同。"套路贷"相关罪名的认定要按不同的处罚原则进行界定。在收集"套路贷"犯罪相关证据时要从不同犯罪阶段有侧重点地进行证据收集。“I'aoludai” crime is not a specific crime. It is a series of criminal acts. There exists the difference between the method and the legal consequence between the “Taoludai” and the folk usury? The determination of the related crime of “Taoludai” should be defined according to different punishment principle. In the collection of the relevant evidence of the ^Taoludai^ crime, the evidence should be collected from different stages of the crime.
