摘　　要：弹性应急组织是在应急管理行政中出现的一种特殊的行政组织形态,美国的FEMA即是这种组织的典型。为了与应急管理在不同情景下的功能需求和资源能力相适用,应急管理组织可能在组织规模、权力范围、组织层级等方面做出弹性化的设计。但是,弹性行政组织的出现必然给职权法定、越权无效等行政法原则带来挑战,需要在法律上做出有效的回应。The flexible emergency organization is a special administrative organization form that emerges in the emergency management administration.The American FEMA is the typical.In order to be compatible with the functional requirements and resource capabilities of different scenarios in emergency management,emergency management organizations may be flexible in terms of organizational size,power scope,and organizational level.However,the emergence of flexible administrative organizations will inevitably pose challenges to the principles of administrative law such as statutory authority and ultra vires,and it is necessary to respond effectively in law.
