摘  要:文章通过分析土地开发权的形成、分配和实现阶段中公、私权力所发挥的作用,厘清土地开发权应属于经济法权;对比分析发达国家与我国现行的土地开发权制度安排,认为我国土地开发权存在的问题主要表现在土地开发权垄断性供给导致供-需失衡、多元化管制导致社会交易成本居高不下、过分强调“涨价归公”导致利益分配不协调等三个方面,建议我国土地开发权制度应采取权随人走、逐级流动、多方式实现等措施予以协调改进。This paper analyzes and studies the role of public and private power in the formation,distribution and realization stage of land development rights,holding that land development rights belong to the category of economic law.This paper tries to find the weaknesses of current land exploitation right system in China by analyzing that of developed countries.There are three representations including the unbalance of supply and demand caused by monopoly,high transaction costs caused by diversified regulation and inconsistent income distribution caused by overemphasize of public appreciation.This paper suggests that the land development right system in China should be coordinated and improved by different measures like the right go with farmers,moving step by step and realizing in various ways.
