摘　　要：中国的知识产权制度,是改革开放的直接成果。本文回顾了中国知识产权制度建立和发展的40年历程,尝试分析了知识产权制度对鼓励创新,促进市场经济发展的内在原因。以便更好地发挥知识产权对经济竞争的激励作用,引领创新文化的形成。China′s intellectual property system is the direct result of reform and opening up. This paper reviewed the 40-year history of the establishment and development of China′ s intellectual property system, tries to analyze the internal reasons of intellectual property system to encourage innovation as well as promote the development of market economy. The intellectual property system may play a positive role in the incentive of economic competition, and lead the formation of innovation trend.
