时代之光:拜占廷《法律选编》中的公正理念

摘　　要：《法律选编》是拜占廷"黑暗时代"最重要的法律文献。在公正理念的指导下,它致力于构建相对平等的家庭成员关系,保护家庭中弱势群体的利益;它致力于构建有序的社会关系,试图规避社会不公正的源头,为平民大众提供安稳的社会环境。《法律选编》维护平民大众、而非贵族阶层的利益,缔造了一个平民大众的时代,这是其公正理念的最高体现。《法律选编》的公正理念源于拜占廷"黑暗时代"元老贵族阶层的式微和传统罗马政治理念的回归,是"黑暗时代"的时代之光。The law book Ecloga came from Byzantine Dark Ages and it followed the idea of justice.It aimed to construct a relatively equal relationship between family members and to protect the interests of weaker groups in families;it also aimed to construct orderly social relations,trying to avoid the occurrence of social injustice,and providing a stable and peaceful social environment for the common people.The Ecloga preferred the protection of the populace interests to that of the aristocracy’s,and thus created an era of the populace.The idea of justice in the Ecloga,which originated from the decay of Senator aristocrats class and the return of traditional Roman political ideas during the Byzantine Dark Ages,was the light of the Dark Ages.
