摘　　要：实践中,政府采购领域中的行政垄断行为严重阻碍了政府采购制度的健康发展,也破坏了市场经济的公平竞争秩序。我国目前对于行政垄断行为的规制还存在许多不足之处,尤其是政府采购领域中一些具有隐蔽性的行政垄断行为难以被规制。我国初步建立的公平竞争审查制度由于缺乏配套的法律法规而未得到彻底的贯彻落实。文章对政府采购领域中行政垄断行为的反垄断法控制进行了初步探讨。首先通过发改委近十年的执法案例对该行为的主要原因、主要表现形式进行了简单分析,然后探索了我国《反垄断法》对该行为的反垄断规制及其不足之处,最后在借鉴他国经验的基础之上对不足之处提出了完善意见。The administrative monopoly in the field of government procurement has seriously hindered the healthy development of the government procurement system and destroyed the fair competition order of the market economy. However, there are still many deficiencies in the regulation of administrative monopoly in China, especially in the field of government procurement. Some of the concealment administrative monopoly behavior is difficult to be regulated. Due to the lack of supporting laws and regulations, the fair competition review system has not been thoroughly implemented in China. This paper made a preliminary discussion on the anti-monopoly law control of administrative monopoly in the field of government procurement. First, we analyzed the main cause and main forms of the law enforcement cases of the NDRC in the past decade. Then, we studied the legal system of anti-monopoly law and its shortcomings for the behavior. Finally, based on the experience of other countries, this paper put forward some suggestions for the improvement of the legal system of anti-monopoly law.
