福建省医疗纠纷第三方调解的实践与优化策略探究

摘　　要：福建省医疗纠纷第三方调解经过多年的实践,取得了一定成效:调解员经过经验积累对现场有较好的把控能力,尝试调解与保险赔偿相衔接,医学专家到调解现场进行会商,将医学会鉴定作为调解的重要参考。但是目前也存在一些问题,体现在调解理念有待完善、调解员的专业化有待提高、专家会商制度在调解中落实不到位、医疗责任保险参与调解的程度不够等方面。应完善调解理念,提高调解员的专业化和职业化水平,加强专家会商制度的落实以及加强与医疗责任保险的配合。After years of practice,the third-party mediation of medical disputes in Fujian Province has achieved certain results:mediators have better control ability on the spot through experience accumulation,try to link mediation with insurance compensation,medical experts go to the mediation site for consultation,and take the appraisal of Medical Association as an important reference for mediation.However,there are still some problems,which are reflected in the following aspects:the attitude towards mediation needs to be improved,the professionalization of mediators needs to be improved,the implementation of expert consultation system in mediation is insufficient,and the degree of medical liability insurance participation in mediation is insufficient.Therefore,the article puts forward the optimization strategies for the third-party mediation of medical disputes in Fujian from the following aspects:improving the mediation attitude,improving the professionalization and professionalization level of mediators,strengthening the implementation of expert consultation system and strengthening the cooperation with medical liability insurance.
