摘 要:1949年10月中华人民共和国成立以来,各国陆续与台湾当局断绝"外交关系"。为推行其所谓的"实质外交"策略,台湾当局在与他国结束官方关系后,对于双方间的既有"协定"总体上采行的是通过协商以尽可能维持"协定"关系的处理态度。实践中,也确有部分"双边协定"得以继续实施。值得注意的是,其中某些"协定"延续的途径既和台湾在国际法上的地位不符,又与各国政府同中国政府的建交公报精神相违背。为在国际社会强调一个中国,维护两岸关系和平发展,中国政府应对台湾与"断交国"之间逾越一个中国原则的行径有所防范。Since the founding of the PRC in 1949,more and more countries in the world have broken off diplomatic relations with Taiwan. However,in order to promote and expand its substantive relations with some countries,Taiwan authorities have been devoted to sustaining bilateral agreements between each other through bilateral consultations. Some bilateral agreements have been actually maintained even after the severance;however,the ways of doing this sometimes are neither consistent with the Status of Taiwan in international law nor with the One-China spirit of the diplomatic communique between these governments and the Chinese Mainland government. Therefore,the Chinese Mainland government should be more vigilant and take precautions against such risks.
