摘　　要：刑事司法鉴定是有一定风险的,在当前以审判为中心的刑事诉讼制度改革已付诸实践,证人、鉴定人和侦查人员出庭作证制度日臻完善,人民陪审员制度逐步试行,司法鉴定责任追究制度呼之欲出的形势下,应当建立有效运行的刑事司法鉴定管理体系,严格按照《检验检测机构资质认定管理办法》等规章制度要求,严把准入门槛,并确保检材/样本的合法性和真实性、确保双方签订《鉴定事项确认书》、严管检材/样本流转的"保管链"、确保检验记录的"六性"、确保授权签字人的技术审核、规范鉴定文书档案的归档等方面进行严格把控,以保障刑事司法鉴定的合法性和客观性。Criminal judicial expertise maybe in disorder.Presently,trial-centered criminal procedure system reform and the testifying system of witness,appraiser and investigator in court are improving,the people’s jury system is in trial implementation and accountability system of judicial appraisal is to be in effect.An effective management system of criminal judicial appraisal should be established strictly according to related regulations such as China Inspection Body and Laboratory Mandatory Approval so as to guarantee the access qualification.The legitimacy and authenticity of samples,the signature of Letter of confirmation,the preservation of samples,the test records,the technical audit of authorized appraiser,the filing of judicial documents must be strictly controlled to ensure the legitimacy and objectivity of judicial appraisal.
