摘　　要：纪检监察合署办公是新时期我国构建新型反腐败制度的重点内容,是制度反腐功能得以充分发挥的关键环节。它直接影响纪法能否有效衔接,也关涉纪检监察内部工作部门及与其他权力监督机构的有效互动和沟通协作。在当前国家监察体制改革背景下,纪检监察合署办公制度在提高反腐效能、整合反腐力量及优化国家治理等方面,仍面临四个亟待解决的核心问题:党委、纪委与监察委之间的相互关系不甚明确,监察对象范围和判断标准难以确定,法治化的纪法衔接机制及保障监察权规范履行的制约机制未能建立。未来新型纪检监察合署办公制度的构建,须明确党的全局领导与纪委、监察委独立履责这一制度前提;厘清国家监察对象范围并确立系统、科学的认定标准;以法治思维为引导,建立统一、有效的纪法衔接机制和健全内部与外部纪检监察权行使制约机制。The co-working system of discipline inspection and supervision is the key content of establishing a new anti-corruption system of China in the new era,and it is also the key part of the anti-corruption system playing the full function.It has a direct impact on the connection between party rules and laws,also reflects the coordination of inner departments of power discipline authority.Under the background of the current reform of the national supervision system,the co-working of the discipline inspection and supervision pattern still faces four core problems:the relationship between party committees,discipline committees and supervision committees has not been clarified;the scope of supervision objects and judgment criteria have not been clarified;the mechanism of coordination that highlights the spirit of rule of law has not been established and the mechanism of restraint that guarantees the proper exercise of supervision power has not been established.For that reason,in the future,our country should clarify the premise of the party’s overall leadership and the independent performance of the discipline and supervision inspection,clarify the scope of the state’s supervision objects and establish a systematic and operable identification standard,establish a unified and effective mechanism for coordination of discipline inspection and supervision under the guidance of the conception of rule of law,and finally improve the internal and external restraint mechanism for the exercise of discipline inspection and supervision power.
