摘  要:推进国家治理体系法治化是推进国家治理体系现代化的题中之义和必然选择。检察权中的捕诉关系改革,是国家治理体系和治理方式改革的重要组成部分,必须以国家治理体系现代化法治化理念为指引,同时,捕诉关系改革又必须遵守检察制度的一般规律和法治发展的普遍规律。我国当前推行的捕诉合一改革,既存在理论论证上的不足,又难以用实证材料支撑。在检察官责任制与员额制推行过程中若忽略配套措施供给,有争权诿责等脱离法治立场的现象,捕诉合一改革将难以达到预期效果。Promoting the rule of law in the national governance system is the key step and inevitable choice of promoting the modernization of the state governance system. The reform of the relationship between arrest and prosecution in procuratorial power is an important part of reforming the system and mode of state governance. Such reform must be guided by the modern ideas of the state governance system and the rule of law. At the same time, the reform of the relationship between arrest and prosecution must abide by the general law of the procuratorial system and the general law of the development of the rule of law. At present, the reform of the integration of arrest and prosecution in China is not only insufficient in theoretical argument, but also lacks support of empirical materials. In the process of implementing the prosecutor responsibility system and the prosecutor post system, if we neglect the supply of supporting measures and fight for power and shuffle responsibility, the reform of the combination of arrest and prosecution will fail to achieve the desired results.
