摘  要:文化产品评判中可能包括了单个文化产品、部分文化产品、全部文化产品的三种评判悖论。基于不同的预设,对这三种悖论能否兼容的回答并不相同。在厘清这些不同预设的过程中,著作权法秩序下文化产业所预设的认识论、体制与产权制度、评判秩序也得以发现,因而,在著作权法秩序下苛求在商业电影中解决前两种悖论,是评判秩序的错位。为发挥著作权制度的优势,以及应对著作权保护文化产业的模式被绝对化及制度失灵的问题,我国应当对文化产品进行更精确的分类,厘清适合不同文化产品的商业模式、产权制度、评判标准。The evaluation of cultural products may include three kinds of paradoxes: a single product, a group of products and all products. To answer the question whether these paradoxes can compatible or not, different presuppositions may lead to different answers. In the process of clarifying these different presuppositions, the epistemology, system and property right system and judging order presupposed by cultural industry under the order of Copyright Law can also be found. Therefore, under the order of Copyright Law, it is a misplacement of judging order to seek solutions to the first two paradoxes in commercial movies. In order to make full use the positive effect of the Copyright Law and deal with the problem of absolutization of copyright protection model and system failure, China should classify cultural products more accurately, and clarify the business models, property rights system and evaluation criteria suitable for different cultural products.
