摘 要:我国行政法中行政控权理论经历了平衡论—行政伦理论—社会治理论—协商民主论的发展过程,这一过程是在风险社会环境渐趋显著情形下形成的理论成果,并主要是在行政实体控权向行政程序控权转变、国家权力控制向社会权力控制转变、以"行政行为"为中心向以"行政过程"为中心转变的多重因素驱动和作用下持续的理论创新。通过对行政控权理论的总结和展望,为更好地行政控权和防范、化解社会风险提供一种路径选择,从而助力于法治国家的早日实现。The theory of administrative power control in China’s administrative law has undergone the development process of balance theory,administrative ethics theory,social governance theory and deliberative democracy theory.This process is the theoretical achievement formed under the situation that the risk social environment is becoming more and more prominent.It is mainly the transformation from administrative entity power control to administrative procedure power control,from state power control to social power control,and from“administrative behavior”to“administrative process”as the center.The administrative process is a multi-factor driving and sustained theoretical innovation under the influence of the central transformation.Through summarizing and prospecting the theory of administrative control,this paper provides a path choice for better administrative control and prevention and mitigation of social risks,thus contributing to the early realization of a country ruled by law.
