从“碎片化”到“整体化”:清单管理制度健全路径探论

摘　　要：清单管理制度建设是厘清政府与市场、政府与社会边界的有效途径和实现公共行政权运行"可视化"的基础性工程,它彰显的是一种"双向度"的权力观,强调权力的民授、为民与受控。目前,清单管理制度仍存在较严重的"碎片化"问题,即权责清单制度、负面清单制度呈现"分割化"态势,清单管理体系中"三张清单"之间缺乏衔接。消解此问题,需要树立"整体思维",实现权责清单制度的"整体化"建设,建立统一与微调相容的负面清单制度,构建"三位一体"的清单管理体系,使清单管理制度建设从"碎片化"走向"整体化"。The construction of the inventory management system is an effective way to clarify the boundaries between government and market,government and society,and it is a basic project to "visualize" the operation of public administration rights.It highlights a"two-way"power concept emphasizing that power is endowed and supervised by the public,thus,as a result,power should serve the public.However,at present,there is a serious"fragmentation"problem.Not only the power and responsibility list system and negative list system present a trend of"separation",but also there is no convergence among"three lists"of inventory management system.To tackle this problem,we need to establish a"holistic thinking"mindset.It is necessary to realize the"integration"construction of the power and responsibility list system to establish a negative inventory system that unification and fine-tuning compatible,and to construct a"trinity"inventory management system so that the inventory management system could move from"fragmentation"to"integration".
