摘　　要：在梳理当前对聚众斗殴犯罪及其转化犯主要研究的基础上,明确了聚众斗殴转化犯的概念、理论基础及基本特征和刑法292条之2款的注意规定之属性,进而提出聚众斗殴转化犯成立的前提条件及构成要件,以期客观、公正地认定聚众斗殴转化犯,减少因理论争议和司法实务分歧导致的法律实施不统一,进而维护法律的权威与尊严,为当前党中央、国务院作出的扫黑除恶专项斗争重要部署提供法治保障,亦为新时代中国特色社会主义建设夯实法治基础。On the basis of combing the current main research on the crime of gathering people and their transformation, the concept, theoretical basis and basic characteristics of the conversion of the crowds and the attributes of the attention of the two paragraphs of Article 292 of the Criminal Law are clarified, and then the crowds are proposed. The preconditions and constitutive elements of the establishment of the transformational offenders, with a view to objectively and impartially identifying the agglomeration of the people, reducing the unification of the law caused by the theoretical disputes and differences in judicial practice, and thus maintaining the authority and dignity of the law, for the current Party Central Committee and the State Council. The important deployment of the special fight against evil and evil has provided the rule of law, and it also laid the foundation for the rule of law for the construction of socialism with Chinese characteristics in the new era.
