缺陷产品召回法律制度研究——以三星召回SM-N9300 Galaxy Note 7系列手机等案为例

摘　　要：缺陷产品召回制度现已成为各国法律制度体系的重要组成部分。在中国,缺陷产品召回制度现在还存在不足。文章通过对两个案例进行法理分析,从主动召回和强制召回、产品的警示缺陷及我国当前所采纳的双重标准进行论述。提出完善我国缺陷产品召回制度的建议,即通过制定专门性立法,引入产品召回保险制度等举措对缺陷产品召回制度进行更好的规制。Defective products recall system has become an important part of national legal system all over the world. However, there are still many problems on defective products recall system in China. This paper discusses from the aspects of active recall and compulsory recall, the warning defects of products and the double standards adopted in China. This paper puts forward some suggestions to improve the defective product recall system in China;that is, to better regulate the defective product recall system by formulating special legislation and introducing the product recall insurance system.
