摘  要:台湾当局不愿接受"一国内部之法域"的法律定位,试图以"独立"的名义和身份开展对外刑事司法合作,有违国际法基本理论和国际社会的普遍现实,进而导致台湾地区由外国移交逃犯面临"协议少、执行难"的困境。尤其是两岸刑事管辖权发生竞合时,关于台籍嫌犯遣返的争议极易引发两岸民意对立,进而影响两岸刑事司法合作。借鉴香港"授权基础上的自治模式",台湾地区可以采用"两岸合作下的自治模式",在《海峡两岸共同打击犯罪及司法互助协议》的法律框架下,加强沟通,通过合作来破解移交逃犯的现实困境。Taiwan authorities is unwilling to admit its legal orientation in international law,and is trying to cooperate with foreign countries in the field of criminal judicature“independently”,which violated the basic theories of international law and common realities of the international community.Accordingly,Taiwan Region is facing difficulties in the surrender of fugitive offenders from foreign countries.Especially when two competing penal jurisdictions of Mainland and Taiwan Region occurred,it would be easy to lead to antagonism of cross-straits public opinions about the surrender of suspects from Taiwan Region,which makes against crossstraits criminal cooperation.Use Hong Kong’s experiences on“self-government mode based on authorization”,Taiwan Region may apply“self-government mode based on cross-straits cooperation”.under the framework of"Cross-strait Joint Fight against Crime and Mutual Legal Assistance Agreement",both sides of the Taiwan Straits should strengthen communication,deepen cooperation,and will finally solve the dilemma of surrender of fugitive offenders in Taiwan Region.
