“三常思维”:法学方法论的统领性思维

摘　　要：法学方法论的常识、常理、常情思维即"三常思维",首先具有包含人性内容的实践价值性,即其拱举着现代人性法治与良心法治,并由此引申出一种法治观。社科法学和教义法学形成且秉持"三常思维"具有应然性。对于社科法学和教义法学的统领性及其对法学方法一元论的支撑,又一道说明着法学方法论"三常思维"的融合性。实践价值性、应然性和融合性使得"三常思维"成为法学方法论的"统领性思维"。最终,"三常思维"凝结着法学方法论的一种学术范式即"融合范式",并引申出一种法学教育观。The thinking of the three common sense and reason of legal methodology has the practical value including humanity.In other words,the thinking holds the rule of law of modern human nature and conscience,which brings about a kind of view of rule of law.That social science of law and doctrinal science of law form and uphold the thinking of the three common sense and reason has the deserved nature.The command of doctrinal science of law and social science of law and support provided to the monism of legal methodology by the thinking illustrate the integration of the thinking of legal methodology together.The preceding practical value,deserved nature and integration make the thinking of the three common sense and reason be the unified thinking of legal methodology.At last,the thinking congeals a kind of academic paradigm of legal methodology that can be called fusion paradigm,and brings about a kind of view of legal education.
