涉外海事裁判文书规范路径探析

摘　　要：伴随着"一带一路"倡议和"海洋经济""海洋强国"等重大国家战略的实施,我国海事活动日益频繁,海洋经济发展迅猛,由此引发的涉外涉海案件呈现出上升的势头。涉外海事纠纷不同于一般的民商事案件,其是否能够及时、公正地处理关系到我国国际形象。涉外海事案件裁判文书恰恰是我国司法精神和对外形象的法律宣示,要制作格式规范,论证充分的涉外海事裁判文书,不仅要跨越国界,还需跨越人文、语言、法律等障碍,只有以强烈的主权意识和开阔的国际视野,加强海事裁判文书中事实表述,说理充分,适用法律准确,方可最大程度地发挥我国涉外海事案件裁判文书的实体价值和程序价值,有力维护国家利益和公平正义,平等保护中外当事人的合法权益,为国家"一带一路"建设、海洋经济发展和海洋强国建设提供有力的司法服务和保障。Along with the implementation of the Belt and Road strategy and other major national strategies like the constructions of the Maritime Economy and the Maritime Power,China’s maritime activities have become more frequent and the maritime economy has developed rapidly,resulting in an increase momentum of cases involving foreign and maritime affairs. Foreign maritime disputes are different from civil and commercial cases in general,and their timely and just settlement determines China’s international image. The adjudication of foreign maritime cases is precisely the legal display of China’s judicial spirit and external image,and it is not only necessary to cross nationality,but also to cross obstacles such as humanities, language and law to make formal and adequately demonstrated foreign maritime adjudication documents. Only with a strong sense of sovereignty,a broad international perspective and a maritime document strengthened in factual statements,reasoning and legal application,can we maximize the substantive and procedural value of China’s adjudicatory documents in foreign maritime and commercial cases,and provide effective judicial service and guarantee for the construction of our nation.
