摘　　要：近年来民事诉讼中法院不认可或是不采纳公安交警部门作出的《道路交通事故认定书》的案件逐年呈上升趋势,可见,公安交警部门和法院认定道路交通事故当事人责任时在法律适用体系、法律原则和价值追求等方面存在一定的差异,这种差异影响了公安交警的执法公信力。对这种差异进行研究,探讨从法官视角认定道路交通事故当事人责任,有助于公安交警部门进一步健全和完善道路交通事故当事人责任认定的理论和方法,提高其科学性和公正性,真正让人民群众在公安交警部门每一起执法办案中都能感受到公平正义。With the continuous deepening of“governing the nation in accordance with the law”,a judicial reform agenda called“making the trial central to the criminal process”puts higher demands on the responsibility of the traffic police department of the public security traffic police department.In recent years,the court did not approve or refuse the cases of the Written Conclusion on the Road Traffic Accident by the traffic police department in the civil litigation,which has been increasing year by year.The traffic police department should actively adapt to the changes of the times,the needs of social development and the needs of the people,and constantly improve and perfect the theory and method of determining the responsibility of traffic accident parties to further improve the law enforcement credibility of the traffic police department.Exploring the responsibility of the parties involved in road traffic accidents from the perspective of judges can break the limitations of the administration,improve the scientific and impartiality of the traffic police department’s responsibility for identifying traffic accidents.It helps to cultivate the traffic police’s awareness,thinking,and way of the rule of law,to embody fairness and justice in the handling of road traffic accidents,to strengthen the awareness of evidence,procedural awareness,and authority of the traffic police department,and to enhance the people’s sense of the rule of law in the field of road traffic.
