摘 要:过错解雇制度赋予了用人单位解雇严重违纪劳动者的权利,从而维护用人单位良好的生产经营秩序。用人单位为了能够降低解雇成本,利用了过错解雇制度在立法上的模糊性,扩张了自身解雇的权利,但这也导致了劳资纠纷的不断产生。过错解雇制度并不是用人单位侵蚀劳动者合法权益的工具,用人单位应当在维护自身权益的同时保障劳动者的合法权益,从而减少劳动争议的产生。明确用人单位解雇权边界、细化规章制度内容、完善适用程序能够减少用人单位在适用过错解雇制度中的争议。The fault dismissal system gives the employer the right to dismiss the seriously disciplinary workers,thus maintaining the good production and operation order of the employer.In order to reduce the cost of dismissal,employers have used the ambiguity of the fault dismissal system in legislation and expanded their right to dismiss,but this has also led to the continuous emergence of labor disputes.The fault dismissal system is not a tool for the employer to erode the legitimate rights and interests of the workers.The employer should protect the legitimate rights and interests of the workers while safeguarding their own rights and interests,thus reducing the occurrence of labor disputes.Defining the employer's dismissal rights boundary,refining the rules and regulations,and improving the applicable procedures can reduce the disputes of the employer in the application of the faulty dismissal system.
