摘 要:尽管我国最高人民法院指导性案例及司法解释中将悬赏广告安排于合同体例中,但由于我国民法尚未规定悬赏广告的具体规则,其法律性质一直是学界争论的焦点。随着《民法总则》的颁布实施,我国民法已经正式确立了意定之债的契约原则,在民事立法未特别规定悬赏广告法律性质的前提下,将悬赏广告以合同行为论遵循了法律解释的本意和一般规则,在法律适用过程中可以有效保障双方交易安全及信赖利益,妥当调整当事人之间法律关系。The reward advertisement is arranged in contract format in the guiding cases and judicial interpretation of the Supreme People’s Court of China. However,as the civil law of China has not yet stipulated the specific rules of the reward advertisement,the legal nature of the reward advertisement has always been the focus of the debate in the academic circles. With the promulgation and implementation of the General Provisions of the Civil Law of the People’s Republic of China,the civil law of China has formally established the contract principle of the intended debt. Under the premise that the civil legislation does not specifically stipulate the legal nature of the reward advertisement,to interpret it as a kind of contract behavior complies with the original meaning and general rules of the judicial interpretation,which can efficiently guarantee the transaction security and trust interests of both parties in the process of legal application,and adjust the legal relations between the parties appropriately.
