党内法规制定主体研究:制度、实践与法理——兼论《中国共产党党内法规制定条例》的完善

摘　　要：党内法规制定主体问题是党内法规研究的基本理论问题,也是构建完善的党内法规制度体系的基础性问题。认识和理解党内法规制定主体范围和权限,需要实然和应然相结合,在制度规定、实践运行和一般法理的互动调适中加以把握。完善现行党内法规制定主体制度,应当进一步明确党内法规制定主体的范围及其党内法规制定权的行使方式,建立党章解释制度和授权立规制度,明确议事协调机构在党内法规制定中的地位和权限。That who the legislative bodies of regulations within party are is both one of the fundamental theoretical problems in regulations within party research and the basis of constructing a sound system of regulations within party. In order to better understand and define the range and power of legislative bodies, attentions should be paid not only to the rules in book, but also the rules in action and the general legal principles. Some measures should be taken to improve the current legislative body system of regulations within party including but not limited to clarifying further the scope of regulations within party' s making bodies and the procedures for exercising their power, establishing the interpretation system of the CPC's Constitution, building the authorized system of making regulations within party, determining the status and authority limits of the deliberative and coordination agencies in the formulation of regulations within party.
